The principal supervising the majority of the teacher’s workload (or as designated by the superintendent) shall be the evaluator of record. An employee assigned to two (2) or more schools shall be observed by the principal of each school. Responsibility for Evaluation Within each school the principal or vice-principal shall be responsible for the evaluation of employees assigned to that school. Subject to the provisions of Section 8.05(c) below and except as otherwise set forth in this Agreement or any Ancillary Agreement, all costs and expenses incurred on or prior to the Distribution Date (whether or not paid on or prior to the Distribution Date) in connection with the preparation, execution, delivery and implementation of this Agreement and any Ancillary Agreement, the Information Statements and the Distribution, and the consummation of the transactions contemplated hereby and thereby shall be charged to and paid by ADA-ES and, ADA-ES shall be solely responsible and liable for any expenses, fees, or other costs that it separately and directly incurs in connection with any of the transactions contemplated under this Agreement or any of the Ancillary Agreements.
